Day 9 – House Divided

I feel VERY STRONG on day 9!  When I close my eyes, the colors I see are a bit brighter than usual.  I had an AMAZING dream – I was bouncing on the earth, and I kept going higher and higher – it was bizarre, as I bounced, the sun got brighter and hotter.  Then after my highest bounce, I landed high up in a mountain that was ice-covered, and the ice was melting from the extra heat that the hotter sun had caused.

I accidentally broadcast some of my thoughts.  I was wondering what day it was, and as I thought, a prisoner in ear shot of me asked another prisoner what day it was.  I won’t need to open my mouth at all pretty soon.  So, as to your question about how day 9 is going:  Wow, I want to go farther than I have ever gone before.

Much gratitude for the 1983 USC info – I know how to use it, and I will put it to good use.

My time in isolation was another fiasco for ACSO:  Lt. Stan Greer threatened me, saying that I would be released “when I eat”.  Ha!  I’m not quitting my religious practice under ACSO threats – and I communicated that to him.  Two days later, he comes and says “ok we will let you out today.”  Then he leaves me there for another three days while all the jailers take my side in the dispute of unjust punishment.

Some deputies LOVE me and some HATE me – like Calloway, who has tried to insult me at meal time in front of the whole dorm.   Some jailers petition Sharon Price on my behalf.

I won that one – I’m back in general population as of a few hours ago.

Fasting from Isolation Cell E4

Captain Price ordered my isolation for 5 days.

I feel like I am being punished for practicing my religion:  I AM a follower of the greatest prophet, Jesus Christ.  Therefore, I practice fasting according to His teachings:

  • Matthew 6:16-17 opens the discussion of fasting.
  • Matthew 9:15 instructs the disciples to fast when they are no longer in the presence of Jesus.
  • Matthew 17:21 says that prayer and fasting will cast out evil.
  • Acts 13:2-3 describes fasting in the early church.
  • 1 Corinthians 7:5 teaches to give yourself to fasting and prayer.
  • 2 Corinthians 11:27 speaks of Paul’s spiritual discipline to fast.

I also follow the Wisdom of Moses, King David, and the prophet Daniel who practiced fasting according to the Holy Bible.  I also follow the Knowledge of the Prophet Muhammad, whom God instructed to eat Syrian Rue in the teachings of the Quran – eating Syrian Rue forces a person to adhere to the dietary laws of Moses:  No pork or shellfish and very little wine or yeast leavening, for example.

I burn sacred incense like frankincense and shittim wood, or acacia, as prescribed by Moses in Leviticus 2:15-16 and Exodus 25:5-6:  Acacia was used to make the most sacred part of the Tabernacle, The Ark of the Covenant, which holds seven lamps and the Altar of Incense.

I also use the knowledge of the ancient shamans who make a sacred drink from acacia and Syrian Rue called Ayahuasca.  Additionally I use the knowledge of the Wise Men of the East, the Magi, who drink Golden Milk made from turmeric and black pepper.  Furthermore, I use the sacred Yopo seed, from the Yopo Tree, which is native to Israel.  The now-extinct natives of the Caribbean Islands, the Taino, grew Yopo Trees in their ceremonial sites in Puerto Rico.

As a US Citizen, the US Constitution guarantees my religious freedom and protects me from persecution because of my religion.  By punishing me for fasting, the Ashe County Sheriff’s Office is violating my Constitutionally protected rights.  I will fast until I cannot stand.

Fasting for Justice

They did not wash laundry last week again.  I need another round of antibiotics; I have a terrible sore throat right now.

I am sick to death of this filthy place.  I am in a new dorm.  This dorm previously housed the females – they also had a lice outbreak.  I feel them all over me at the moment – I don’t even know if this is lice – I see nothing, but I feel them.

When Thomas Jefferson said “Give me liberty or give me death,” he was NOT suicidal, and neither am I.  Quite to the contrary:  Give Me Life!  Let Me Live!  My pursuit of happiness is literal:  www.SyrianRue.org/happy

Fasting is a religious right and a spiritual discipline.  It never leads to death – rather, it leads to better health.  I will not put my life in jeopardy – at 20 days, I was never close to putting my life in jeopardy.

Brother, the idea of a hunger strike is lifting my spirits – it is literally my last recourse to this injustice.  I despise the thought of just rotting away in this filthy, disease-infested jail while I hold hope and prayers for my next court date – currently over a month away.

Administration may claim that I am suicidal in order to punish me with medical isolation.  They may even forbid me clothes with which they claim I might hang or choke myself.  Please do not allow them to do this!

Give me life, liberty, and the pursuit of happiness – don’t give me death.  This place is killing me.  I am anxious to experience the spiritual clarity I remember setting in after 15 days or so – maybe I will go further than before.  This is about more than myself.

Prescription for Depression

My freeworld diet was high in MAOI’s.   In this place, I have become incredibly depressed – months of captivity in filth, with no sunlight, no fresh air, no exercise, and a constant threat of violence are all slowly murdering my soul.  

The doctor prescribed Citalopram:  I used it for about two weeks before I began to experience a side effect of twitching headaches.  I asked the doctor to prescribe an MAOI due to my experience with natural MAOI’s.  

He refused, and instead prescribed Zoloft.

I asked the nurse to print out the side effects for me.  In my opinion, it is criminal to give out harmful drugs like Zoloft, which causes insomnia in 21% of people, nausea in 26% of people, headaches in 22% of people, and a host of other side effects.

I asked the nurse for natural antidepressants, which do not require a prescription and are not controlled substances – I want Syrian Rue.  I want Golden Milk (turmeric & black pepper). 

She said that is not allowed. 

My depression is serious.  I rarely get out of bed anymore.  Some animals cannot be kept in captivity because they essentially lose the will to live – they stop eating.  The food here is poison anyway – even before they poison it.  

At Caldwell, a neighboring county – prisoners are known to have been punished with a water soluble poison that is gone from the body in 72 hours – this is not to kill a person, but to sicken and torture them.

The extent of the corruption is deep.  One person overheard police discussing if they should plant meth on him because they didn’t find any.  In his case they did not, but it’s common.

Searching a property immediately after a fresh arrest is detained in isolation is common here, too – I have met two others that had the same thing done to them.

Inside here, I feel like there is not much left that I can do to help myself.

Official Capacity

The situation I am in is unbearable.  I have virtually no access to law books and I am facing 20 years while being fully self-represented.

I have been asking night shift and day shift deputies for ‘legal request forms’ – paper forms that Sharon Price says must be used for any law lookup request.  Day shift, after being reminded several times, ignored my request.  The night shift said they don’t even know what is a ‘legal information request form.’

Finally, I obtained a nearly impossible to obtain and official “legal request form”:  I asked for the 2018 federal sentencing guidelines for DMT and a list of motions relevant in District Court.

The form was returned, answered by Sharon Price:  She said she is not obligated to give me any legal reference material besides “the general statutes with which I am charged.”  She is mistaken.

Additionally, she took the liberty to offer her own legal advice – which I did not ask for:  Captain Sharon Price wrote, “What you need to do is request standby counsel to be appointed by a judge, as I understand that as of 9-20-18 Mr. Baker is no longer your court-appointed lawyer.”

Huh?  She won’t provide me the legal reference about my rights for standby counsel, despite in a previous hearing I actually requested exactly that and the judge told me “he thinks but is not certain that North Carolina no longer allows standby counsel.”

Where does Captain Sharon Price derive her advice from?  Why is she advising me now?  Now that Garland Baker is not?  The four motions I just properly filed and served on the DA on the 20th – have they been heard?  Why could they not be heard that day?  Do I need to be put on the docket to have them heard?  How is that done?  Why will the DA not speak directly with me?  Especially if I have no legal counsel?

Mite be Scabies

I was threatened in front of the whole dorm:  I told the jailer that this [lice] outbreak is the fault of the administration here – and a deputy went off!  Yelling and threatening to have me “sent to the hole for my opinion” – he was pissed.

The inmates moved away from the deputy and encouraged me to do likewise; they feared that I would be beaten off-camera, then accused of assaulting the jailers:  I was not even disrespectful when I stated that uncleanliness lead to the outbreak, and that the administration is responsible for the cleanliness [of the detention center].

There is plenty of debate in this dorm about mites or scabies being in here – there seems to be more than lice:  There is an unknown skin condition affecting about a third of us. One person has what several of us think is a staph infection.  Another person has a positively identified case of ringworm – and has been given the correct anti-fungal medicine for it.

After my first arrest for marijuana – my landlord told me that several of the guys he works with from this area were arrested and held for 72 hours – and they came out of the jail with lice.  This is a VERY reoccurring problem here in the detention center, and the administration has “their own way of handling it” – which some might call insufficient.

Some family members are complaining from the outside.  One prisoner here – his mother worked in another jail for McDowell County, so she called a sergeant at that county to get resources about lice outbreaks.  It was not handled properly here – when she worked as a jailer at McDowell County, lice outbreaks were handled much differently.

They made everybody strip their bedding and sit around in underwear for about five hours today – when the laundry came back, it was still damp.  There is a rumor that we will all be forced to shave our heads bald – or be moved to isolation if we refuse.  Since I have court tomorrow, I may choose isolation and treat my infected scalp properly – certainly if I am released.

We are all itching.  We constantly ask for cleaning supplies – and we are constantly denied.

Officer Chris Eldreth never called me back, but Sheriff Jim Hartley did:  He advised that I put my grievance in writing and mail it to him, so I did:  Certified mail goes out tomorrow, and emails have already been dispatched.  I post my grievances here for the record, and because I’m concerned about Brian’s safety and well-being.

My first grievance concerns the abjectly unprofessional treatment I received from Officer Chris Eldreth on the morning of Friday, September 7, 2018:  I agree with Officer Chris Eldreth’s assessment that if I was physically in Ashe County, I would be unable to oppose the violence of ACSO – I hope my 1,500 mile distance is enough of a firewall to keep the boots of ACSO off my neck.

My second grievance concerns the incomplete and out-of-date contents of the legal library at the ACSO detention center:  By all accounts, the condition of the law library, and possibly the detention center as a whole, is abysmal.

How the ACSO Grievance Process “Works”

I called the ACSO this morning to file a grievance with them about the condition of their legal library in their detention center:  Their library is grievously out-of-date and incomplete.

After calling them back (they put me through to voicemail first), I was transferred to and greeted on speakerphone by at least one person who identified himself as Officer Chris Eldreth.

I introduced myself to Officer Eldreth and thanked him for helping me to file a grievance.  I explained to him the nature and substance of my complaint, and I told him I am looking for two things from the grievance:

  1. I’d like to know who is responsible for the legal library in the detention center.  If it’s not ACSO, then who?
  2. I’d like to have an inventory list of the legal library in the detention center.

When I asked Officer Eldreth how the grievance process gets started, he didn’t answer my question and instead began to aggressively interrogate me.  For a few minutes, I answered his barrage of questions, despite his repeated and hostile interruptions.

Officer Eldreth refused to answer every single question I asked him – so I finally asked him if he was also going to refuse to accept my grievance.

Silence.

So I asked the question again:  “Are you refusing to accept my grievance?”

Still no answer.

I asked him if we were on a recorded line, and for a third time, “Officer Eldreth, are you refusing to accept my grievance?”  Finally, he answered my question – by hanging up the phone.

The secretary sounded confused when I greeted her for the third time – I called back; maybe the call got disconnected…  She put me through to Officer Eldreth – and I got his voicemail.

How’s THAT for a grievance process?

Notes from the investigation

The Ashe County Sheriff’s Office just got served a lawsuit.  Seems like the felonious problems with their last sheriff won’t just end in public outrage and a sweetheart plea – there is now the civil matter of “flagrant and unlawful abuse of power” wherein “former employees who dared to speak truth to power faced unlawful consequences in the form of retaliatory firings, malicious prosecution, and a defamatory public relations smear campaign.”  If that’s how the ACSO treats its own employees, how does it treats its prisoners who try to speak truth to power?  And what was going on that one of the plaintiffs is a four-year-old child?

1.  They found two 10 kilo bags of peganum harmala – almost gone – evidence suggests that this was NOT a DMT lab but an Acetyl-cholinesterase-inhibitor (AChI) medicine lab – which is consistent with the research publication he has made at ResearchGate.net.

2.  Brian is also researching anti-depressant alternative natural medicines.  DMT is an analog of serotonin.  SSRI’s and sNRI’s work by indirectly raising serotonin levels.  Yopo seeds and some grasses contain serotonin (and DMT) – one extraction pulls both but then they must be split.

3.  Brian has posted very detailed answers about extraction and splitting of the medicines found within Syrian rue (peganum harmala).  He is looking forward to using evidence from his laptop for his defense.

Criminal Injustice

My name is Brian Aberle.  I am a chemist and plant medicine researcher. I have professional experience in oncology with Siemens Medical and management-level experience in health care systems at Kaiser Permanente.  I research natural plant medicines that are alternatives to pharmaceutical anti-depressants.  I publish a website about my work:  http:\\SyrianRue.org\happy.

I also research plant medicine to cure neurodegenerative diseases like Alzheimer’s, which are generally treated with a class of medicine called Acetyl-Cholinesterase-Inhibitors (or AChI’s).  I published a Ph.D. level thesis outline titled “Neurodegenerative Disease Cure 2018” at ResearchGate.net where I publicly answer chemistry questions about my work.  I have posted answers about how to properly neutralize caustic mixtures for environmentally safe disposal as well as more advanced questions about how to isolate individual alkaloids such as harmaline found in Syrian Rue.

Shortly after I relocated to Ashe County, deputies of the Ashe County Sheriff’s Office illegally searched my home.  North Carolina does not recognize my California medical permits, and the illegal search yielded marijuana, most of it decarboxylated, which makes it orally active, and has been found to be the most effective form for cancer treatment or use as an AChI medicine.  Although it was discovered illegally, and despite the fact it was not being sold, I plead guilty to two felonies and was placed on probation.

I was assigned to a probation officer named Timothy Moretz.  When I introduced myself to Officer Moretz, I explained to him my work in chemistry,  and how I research the effects of plant medicines on neurotransmitter levels in the brain – how anti-depressants such as SSRI’s, SNRI’s, and MAOI’s work by raising serotonin and DMT levels, which exist naturally, or endogenously, in the human brain.  And that some plants such as Yopo contain both serotonin and DMT…  Timothy’s response to me was that “the world is overpopulated” and that “advancements in healthcare and medicine are to blame”.

After being on probation for about a month, my home was once again maliciously raided and aggressively searched.  On June 21, 2018, Timothy Moretz overstepped the law and with nine other officers, came into my home unannounced and for two hours searched my house.  One of the officers produced, a small amount of mushrooms from within my freezer.  Officer Moretz presumed them to be hallucinogenic, whereupon he arrested me and had me charged with a felony.

I was then thrown into an isolation cell at the Ashe County Detention Center for 41 days.  I was initially deprived of phone access as well as the communication kiosk during my weekly trip to the shower.

Once Timoty Moretz had me falsely imprisoned, he returned to my home that very evening to trespass onto my property and continue his unlawful ransack of my papers, plants, my laboratory – my entire home.

Ahead of any evidence, Timothy Moretz got a search warrant from Judge Puckett, absurdly based on a statement I made to him about plants and urine containing DMT.  He returned with his absurd search warrant, and as Michael Sheron from the North Carolina State Bureau of Investigation described it, a “fiasco” ensued.

Upon the execution of Timoty Moretz’s search warrant on June 26, no shortage of emergency services were summoned:  What Timothy presumed to be an explosive device turned out to be just an oil lamp and an incense burner – as confirmed by the bomb squad, who were there after being dispatched to respond to Moretz’s emergency situation.  Three fire departments were dispatched:  Todd, Fleetwood, as well as the Meat Camp Fire Department.  The Ashe County Rescue Squad was also at the scene, along with NCSBI and the Health Department:  Timothy also falsely presumed that my chemistry equipment was a meth lab.  However, the Health Department verified it was NOT a meth lab, and refused to dismantle and dispose of anything, going so far as to cite the legal entanglement of destroying someone’s property.  This did not stop the Ashe County Sheriff’s Department from having my entire lab dismantled and destroyed.

I had in my inventory many different legally-obtained plants, seeds, tree resins, chemicals, and equipment used for the making of medicine crucial to my research.  In total, 138 items were confiscated and destroyed.  For all of the Sheriff’s Office’s destruction, they claim to have found LESS than 1/10th of a gram of DMT with serotonin in it.

After Timothy’s fiasco on the 26th, he then charged with three Class A felonies:  This time for allegedly manufacturing and selling DMT – charges even more ridiculous than the first.  However, because Timothy had upped the ante with more felony charges, my bond was then raised from the initial $50,000.00 to $300,000.00.

On August 23, 2018, WSOCTV.com reported on the evening news that the Ashe county Sheriff’s Office has been charged with “False Arrests” and “Malicious Prosecution” amid other charges of misconduct, including forcing deputies to lie in statements.  I have personally witnessed and will testify that these allegations are only the beginning of the corruption and malfeasance within the Sheriff’s Office.

I have been imprisoned in the Ashe County Detention Center since June 21st.  My case has been repeatedly “continued” now until October 18th – despite my written request to the court to speak at a hearing.  I have not had an opportunity to speak a single word before a judge-prosecutor.  According to North Carolina General Statutes Chapter 15A Article 30, the court has failed to conduct a “Probable Cause” hearing within the maximum time allowed by law.  As of August 30, lab results have still not determined if the mushrooms were hallucinogenic or simply just vegetables.

Please share this injustice with other medicine research groups or internet groups concerned with human advancement, or truth and liberty; the criminality going on in the Ashe County Sheriff’s Office must be exposed.
